These Terms of Use (“Terms”) govern your access to and use of the Nunu Orbit mobile application and related websites/services (the “Service”).

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Medical & developmental disclaimer. Nunu Orbit provides general educational information about typical developmental leaps and parenting context. It is not medical advice, diagnosis, or treatment, and it does not replace care from a qualified pediatrician or other healthcare professional. Always seek professional advice if you have concerns about your child’s health or development. If you believe there is an emergency, contact local emergency services immediately.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. The Service is for parents and caregivers, not for children as account holders.

2. Accounts

Provide accurate information and keep your credentials secure.
You are responsible for activity under your account.
Notify us promptly at support@nunuorbit.app if you suspect unauthorized access.

3. Acceptable use

You agree not to:

Misuse the Service, attempt unauthorized access, or disrupt systems.
Upload unlawful, harmful, or infringing content.
Scrape, reverse engineer, or resell the Service except as allowed by law.
Use the Service to provide clinical care or to impersonate others.

4. Subscriptions & payments (placeholder)

Nunu Orbit may offer free features and optional paid subscriptions. TODO: finalize pricing, trial length, and renewal terms.

Purchases made through the App Store or Google Play are billed by Apple or Google under their terms. Manage or cancel renewals in your store account settings.
Unless required by law or store policy, fees are generally non-refundable once charged.
We may change prices or offerings with notice where required; continued use after the change takes effect constitutes acceptance.

5. Intellectual property

The Service, including branding, text, graphics, and software, is owned by Nunu Orbit or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial parental use in accordance with these Terms.

6. User content

You retain rights to content you submit (e.g. baby profile notes). You grant us a license to host, store, and process that content solely to operate and improve the Service. You represent that you have the right to provide the information you enter.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that content is complete, current, or suitable for every child.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUNU ORBIT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD 50.

9. Termination

You may stop using the Service and delete your account at any time (see Delete account). We may suspend or terminate access if you violate these Terms or if we discontinue the Service.

10. Changes

We may update these Terms by posting a revised version on this page. The “Last updated” date will change accordingly. Material changes may also be communicated in-app or by email when practical.

11. Governing law

These Terms are governed by the laws of TODO: jurisdiction (e.g. country / state), without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
